**WEB DESIGN SUBSCRIPTION AGREEMENT**

This Web Design Subscription Agreement (the “Agreement”) is entered into between Red Cherry IT, a web design agency, located at 16 Clifford Gardens, Crawcrook, Tyne & Wear, NE40 4UB, United Kingdom (hereinafter referred to as the “Company”), and the customer (hereinafter referred to as the “Customer”).

1. DESCRIPTION OF SERVICES

1.1 Features Exclusive to Starter, Business, and Ecommerce Subscriptions

The following features are included exclusively with the Starter, Business, and Ecommerce subscriptions:

  • Mobile responsive website
  • Website live within 14 days
  • Dedicated account manager
  • Unlimited update requests
  • Domain, web, and email hosting
  • Maintenance and updates
  • Daily backups
  • Google Analytics

1.2 Subscription Tiers

1.2.1 Business Subscription

1.2.2 Ecommerce Subscription

4. PAYMENT

4.1 Monthly Payments: The Company will charge the monthly fee based on the chosen subscription plan to the payment method provided at purchase. All payments can be paused or cancelled anytime.

5. REFUNDS

Refunds are generally not standard procedure. However, in rare instances where there may be a potential shortfall in meeting Customer expectations, the Company is open to case-by-case discussions.

6. OWNERSHIP

6.1 Customers subscribing to Business or Ecommerce plans have full ownership of their domain, website, content, and emails and can freely migrate or transfer their services at their convenience.

6.2 Domain Transfers: Domain transfers are subject to the policies and standards set by ICANN, the governing body for domain registrations. Transfers cannot be initiated within the initial 60 days.

7. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.

AGREEMENT ACKNOWLEDGEMENT

By proceeding with the Stripe Payments checkout process, you, the Customer, acknowledge and agree that your acceptance of these terms and conditions is equivalent to signing this Agreement.
